How to book a Cruise.    

 

 

TERMS & CONDITIONS.

1: Bookings
(a)The submission of a completed booking form shall constitute an offer by the customer and the contract shall come into existence only when Reed Boats despatches written confirmation to the customer.
(b) Reed Boats reserve the right to refuse a booking at this stage, without stating the reason for doing so.

2: Deposit
The customer must send an initial payment equal to 20% of the total price of the cruise ("the price") as a deposit ("the deposit") and part payment towards the cost of the cruise. The deposit will be returned if the booking is not confirmed by Reed Boats.

3: Balance outstanding
(a) The balance of the price outstanding must be paid no later than 28 days before the start of the cruise.
(b) Reed Boats reserve the right to levy a surcharge if the rate of VAT or other relevant tax is increased between the date of sending the confirming letter and the start of the cruise.

4: Late bookings
If a booking is made within six weeks of the start of the cruise, full payment of the price must be submitted with the booking form. It will all be refunded if the booking is not confirmed by Reed Boats.

5: Booking cancellations
(a) If a customer wishes to cancel a cruise the customer shall notify Reed Boats by telephone 07977 229103and shall immediately thereafter confirm such cancellation by writing to Reed Boats at "Reed boats, 2 Lyons Lodge, Withington, Cheltenham, Gloucester, GL54 4BH", the cancellation dates from the date the letter is received.
(b) If a customer cancels at any time after receiving our confirming letter and prior to the cruise commencing, Reed Boats will endeavour to relet the cabin or cabins. If the cabin or cabins are relet, the deposit only is forfeited. If however Reed Boats is unable to relet the cabin or cabins, the customer will be liable for the full amount of the price.
(c) If only the deposit is forfeited pursuant to clause 5(b) above but the customer books an alternate cruise to take place within the period of one year from the date of cancellation, Reed Boats will give the customer a credit against the price of that cruise equal to the amount of the forfeited deposit.
(d) Changes to Holiday dates by the customer after confirmation has been sent by Reed Boats counts as a cancellation and clause 5 (b) will apply.
(d) Reed Boats strongly advise that all customers obtain holiday cancellation insurance to cover the cost of cancelling a booking.

6: Pets and children
(a) Reed Boats will not carry pets of any kind on any standard cruise.
(b) Reed Boats will usually not accept a booking from any party which includes children under the age of 14.
(c) If the booking is a charter booking, (i.e. the part concerned has booked full use of the butty), then clauses 6 (a) & (b) do not apply.

7: Operators right of termination
(a) Reed Boats reserves the right to terminate a passenger's cruise should the person in the opinion of Reed Boats or its crew have placed the boats/equipment/passengers or property of the Waterways company in danger of damage or injury by ignoring the advice or restrictions imposed in order to protect against damage or injury to persons or property whilst travelling with Reed Boats. Reed Boats also reserves the right to expel any person found smoking inside the vessels, or who on the opinion of the master of the vessel exhibits behaviour disruptive to the group. No compensation will be returned for cruise time or facilities cancelled due to this action. This clause applies also to future bookings that may have been made with Reed Boats, in which case any monies will be returned.
(b) Reed Boats reserves the right to cancel a cruise if in the reasonable opinion of Reed Boats insufficient cabins on the boats are let and in such event Reed Boats shall be liable to refund the customer the full amount of the price but shall have no other liability to the customer whatsoever or howsoever arising.
(c) Reed Boats shall be under no liability for any failure to perform any of its obligations under this agreement by reason of any cause of any nature or kind beyond its reasonable control.
(d) Reed Boats retain the right to cancel without reason any booking giving six months' notice and returning all deposits paid.

8. Accidents and losses.
(a) Except in respect of death or personal injury caused by Reed Boats negligence, Reed Boats shall not be liable to the customer by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the expressed terms of the Contract, for any loss or damage (whether consequential or otherwise), costs, expenses or other claims for loss or damage or compensation whatsoever (and whether caused by negligence of Reed Boats or its employees or agents or otherwise) which arise out of or in connection with the cruise. Passengers are recommended to have their own personal and baggage insurance.
(b) No responsibility can be taken by Reed Boats for any consequences of not being informed regarding health or dietry problems of any passenger.
(c) If Reed Boats suggests or arranges car parking, it is nor responsible for any loss or damage to the vehicles or their contents whatsoever. That is between the owner of the car and the owner of the car parking.

9. Alterations from published cruise plans.
(a) Every effort will be made to keep to the advertised cruise timetable but Reed Boats reserve the right to alter or amend the published cruise route, if this is made necessary by canal stoppages, water shortage, flood, or if we deem it to be in the best interests of the passengers. A passenger will have no claim on us, and no particular right of cancellation, other than set out in clause 5, should any re-routing be necessary.
(b) Reed Boats are not responsible for any loss to a passenger caused by delay, mechanical breakdown, or any other cause.
(c) If alterations are required to cruises not yet started then notification will be sent to customers concerned at the address on the booking form and by telephone to the contact number they have given as soon as the alteration is known.

10. These conditions will operate in accordance with English Law and the parties submit to the jurisdiction of the English courts.
